We’ve assisted many people who have tried and failed to obtain an ITIN number from the IRS. Most have multiple applications that have been rejected and still no number. Here are some examples of where an ITIN application was rejected.

Example 1

One of our clients was an elderly couple in their 70’s and 80’s who had sold a Maui based timeshare in the US. They wanted to claim the tax back held under FIRPTA for all non-residents. They had an ITIN certification rejected by the IRS and needed assistance.

They had been advised by the UK passport office not to send their passports and were looking for a Certified Acceptance Agent to assist them. After multiple tries with different notarised versions (including a bank notarised passport copy), hand written letters explaining their situation and almost a year of trying, Just Breve were able to assist in ensuring the W-7 ITIN application was complete with all supporting documentation and our certification of their UK passports. ITINs were timely issued within 7 weeks of the package being received by the ITIN office.

Example 2

Another client had an application to the IRS that had dragged on 3 years and needed to settle before being time barred for his refund. He had sold a Marriott timeshare in late 2014, and again, because he was non-resident, was subject to FIRPTA withholding on the sale. His notarised ID wasn’t accepted and the ITIN application rejected. He had tried over multiple years to get an ITIN issued. He had wrote to the IRS again but they had not replied and when they did kept sending standard letters and notices without proper and clear instructions.

Just Breve were able to assist in ensuring all paperwork was completed including certifying his passport so he did not have to mail it to the US. His ITIN was issued within 7 weeks.

Example 3

In our final example, we assisted a client who had applied for an ITIN herself and sent a US 1040NR tax return with the application. The ITIN was rejected and a temporary taxpayer identification number issued (also known as an Internal Revenue Service Number or IRSN). Her claim for a tax refund was also on hold until the ITIN was issued. She again, had sent a notarised copy of her passport which had been rejected and an IRS rejection notice received.

We met with the client in her home with all paperwork prepared and ready for signature. All the client needed to do was sign and show her original passport to confirm her identity and foreign status for the ITIN certification. Her ITIN was issued within 8 weeks.
